Terms and Conditions

IMPORTANT: Before you make any payment for purchase of goods or services under the RHB Bank Smart Pay Service, please read these terms and conditions carefully and make sure that they are well understood

  1. If the Cardmember wishes to acquire, and RHB Bank agrees to provide, the Smart Pay Service, the terms and conditions of the Cardmember's Agreement, these terms and conditions and any other additional terms that apply to the Smart Pay Service as specified by RHB Bank at its sole and absolute discretion from time to time (collectively Terms and Conditions) will apply.

  2. Each Cardmember will be deemed to have accepted the Terms and Conditions when the Cardmember makes payment for any purchase of any goods or services under the RHB Bank Smart Pay Service programme.

  3. Any Cardmember may apply to pay the Bills for any transaction(s) approved by RHB Bank, provided the total amount to be debited is within Cardmember's approved available Card Limit.

  4. Until the Cardmember receives notification from RHB Bank, whether by way of an entry in the monthly statement or otherwise, the Cardmember is obliged to settle, and shall settle, all outstanding bills of the Merchants whose bills are, at the Cardmember's request, to be paid under the Smart Pay Service and RHB Bank shall not be liable for interest on any overdue payment or any other charges incurred as a result of the Cardmember's and/or RHB Bank's failure or delay in making payment before or after the due date.

  5. Where the Bills are issued by Merchants who are municipal authorities, the Cardmember must submit the Smart Pay application form to RHB Bank: -

    1. on or before 10 December of the year to be successfully included under the Smart Pay Service for the payment of the Bill for the 1st half of the year's municipal assessment and subsequent Bills; and

    2. on or before 10 June of the year to be successfully included under the Smart Pay Service for the payment of the Bill for the 2nd half of the current year's municipal assessment and subsequent Bills.

  6. Where the Bills are issued by any telecommunication companies as the relevant Merchant, the Cardmember hereby expressly acknowledges that the Cardmember is obliged to inform RHB Bank in writing upon disconnection of any telephone lines or of any changes in the enlisted telephone numbers or the bill account numbers. Notwithstanding any charges to the particulars aforesaid, RHB Bank shall be entitled to continue to debit the Card Account until RHB Bank receives actual notices of such changes.

  7. In the event that the Cardmember has previously instructed the Merchants to charge the Bills to the Cardmember's credit or charge card account maintained with any other credit or charge card issuer, the Cardmember must inform the Merchants that such instructions are to be treated as revoked and of the change in the paying instructions.

  8. RHB Bank reserves the right not to make payment of any or all of the Bills which the Cardmember has requested be paid under the Smart Pay Service without assigning any reasons therefor and RHB Bank shall not be liable for any claims, losses, costs, expenses or damages of whatsoever nature arising from RHB Bank's refusal to make payment of any or all of the Bills as aforesaid.

  9. RHB Bank accepts no responsibility to make payment of the Bills at any time or in a timely manner, and RHB Bank shall not incur any liability through any error, neglect, refusal or omission (whether by its negligence or otherwise) to make, or any delay in making, payment of any or all of the Bills to the Merchants.

  10. In the event of any dispute pertaining to the Bills or the provision of any goods or services with the Merchants: -

    1. the Cardmember shall resolve such dispute directly with the Merchants;

    2. the liability of the Cardmember and his obligation to make payment to RHB Bank shall not be affected by any such dispute, or any counterclaim or right of set-off which the Cardmember may have against such Merchants; and

    3. the Cardmember shall not withhold payment to RHB Bank Berhad on account of any such dispute, counterclaim or right of set-off under circumstances whatsoever; and

    4. RHB Bank shall not be responsible for investigating or resolving any such dispute or for the dispute itself, and shall not be liable for making payment of the Bills to the Merchants or for debiting the amount of theBills to the Card Account even if RHB Bank has notice of such disputeand the Cardmember hereby undertakes not to enjoin RHB Bank as a party to any such dispute or to any legal proceedings in relation to such dispute.

  11. RHB Bank reserves the right at its sole and absolute discretion to amend or alter the Terms and Conditions from time to time without prior notice and such amendments and alterations shall be effective and binding on the Cardmember with effect from the date of the amendments or alterations notwithstanding that the Cardmember may not have written notice of the amendments or alterations. In the event of any dispute relating to the Terms and Conditions, the determination and decision of RHB Bank shall be final, binding and conclusive.


  12. In the event of any inconsistency between the English version and the Bahasa Malaysia translation of these terms and conditions, the English version shall prevail to the extent of such inconsistency.
